Part I – AUTHORITY, JURISDICTION, AND PRINCIPLES

Creation and Force
His Majesty, the King of Falleen, as Sovereign by the authority of the Charter of Confederation and in conformity with Article IV of the same, has established this Criminal Code for the maintenance of law and order.

Application
This Code has full force and effect upon:
all members, citizens, employees and agents of the Falleen Federation,
all foreigners who are within Falleen Federation space, as defined by the Falleen Federation, and
any sentient being who may have committed an offense against the Falleen Federation, or whose intentions are to harm the interest of the Falleen Federation.

Classes of Offenses
The Falleen Federation Penal Code recognizes the following offenses:
*Capital Offenses
*Felony Offenses
*Minor Offenses

Judicial Process
All sentient beings not considered a Falleen Citizen, accused of a violation of this Code by a Representative of the Falleen Federation, are to be considered guilty of the act until such a time as the accused has proven their innocence before Tribunal Court members of the Falleen Federation.

Presumption of Innocence
Where a Code provision creates an offense and authorizes a punishment to be imposed:
a Citizen of Falleen shall be deemed not to be guilty of the offense until he is convicted or discharged; and
a Citizen of Falleen who is convicted or discharged of the offense is not liable to any punishment other than the punishment prescribed by this Code or by the Code provision that creates the offense.

Parties to Offense
Anyone is a party to an offense who:
actually commits it;
does or omits to do anything for the purpose of aiding any person to commit it; or
abets any person in committing it.

Part II – OFFENSES AGAINST PUBLIC ORDER

Section I – Treason and Other Offenses against the Sovereign’s Authority and Person

High Treason – Capital Offense
Anyone who commits high treason in the Falleen Federation:
kills or attempts to kill the Sovereign or Royal Court member, or does them any bodily harm tending to death or destruction, maims or wounds him, or imprisons or restrains them;
levies war against the Falleen Federation or does any act preparatory thereto; or
assists an enemy at war with the Falleen Federation, or any armed forces against whom Federation forces are engaged in hostilities, whether or not a state of war exists between the Falleen Federation and the faction whose forces they are.

Treason – Capital Offense
Anyone who commits treason in the Falleen Federation:
uses force or violence for the purpose of overthrowing the crown or government of the Falleen Federation or a crown corporation thereof;
without lawful authority, communicates or makes available to an agent of a faction other than the Falleen Federation, military or scientific information or any plan, article, note or document of a military or scientific character that he knows or ought to know may be used by that faction for a purpose prejudicial to the safety or defense of the Falleen Federation;
conspires with any person to commit high treason or to do anything mentioned in paragraph (a);
forms an intention to do anything that is high treason or that is mentioned in paragraph (a) and manifests that intention by an overt act; or
conspires with any person to do anything mentioned in paragraph (b) or forms an intention to do anything mentioned in paragraph (b) and manifests that intention by an overt act.

Omitting to Prevent Treason – Felony Offense
knowing that a person is about to commit high treason or treason does not, with all reasonable diligence, inform a Minister or other officer of the crown or make other reasonable efforts to prevent that person from committing high treason or treason.

Section II – Prohibited Acts

Intimidation or Harassment of a Federation Member – Minor/Felony/Capital Offense
Anyone who commits an offense of intimidation or harassment towards a fellow federation member. This includes creating an intimidating, hostile, or offensive working environment through verbal, physical, or sexual harassment, including bullying other members.
First warning – Minor Offense
Second warning – Felony Offense
Third warning – Capital Offense

Insubordination – Minor/Felony/Capital Offense (separate from the Military Code of Conduct)
Anyone who outwardly or through their actions defies their superiors by not following proper chain of command or refusing to obey reasonable instructions given to them by a superior. This can also include insolence, defined as haughty and contemptuous or brutal behavior language; lacking usual or proper respect for rank or position; or acting presumptuously disrespectful or familiar towards equals or superiors.
Insubordination towards Officers of the Falleen Federation – Minor Offense,
Insubordination towards members of the Council of Lords – Felony Offense,
Insubordination towards the Crown – Capital Offense

Dereliction of Duty – Minor/Felony/Capital Offense

Sabotage – Felony Offense
Anyone who commits an offense by impairing the efficiency or impeding the working of any ship, vehicle, item, droid or other thing, or causes property, by whomever it may be owned, to be lost, damaged or destroyed.

Espionage – Felony Offense
Anyone who commits an offense by:
Requesting enlistment into the Falleen Federation for the purpose of spying, or
Selling intelligence period, or
Is a Federation agent, working outside the federation for impure reasons.

Mutiny – Felony Offense
Anyone who commits an offense who:
attempts, for a traitorous or mutinous purpose, to seduce a member of the Falleen Forces from his duty and allegiance to His Majesty, or
attempts to incite or to induce a member of the Falleen Forces to commit a traitorous or mutinous act.

Trespassing – Minor Offense
Anyone who commits an offense who trespasses where it is deemed unacceptable for travel by the Sovereign or his representatives. This includes:
Cities, systems, planets, sectors and everything therein of restricted territories

Piracy – Minor Offense [unless kidnapping, then Felony]
Anyone who commits an offense whose unlawful presence, action, theft, or violence disrupts the King’s peace or lawful galactic travel or trade such as:
steals a Falleen ship,
steals or without lawful authority jettisons, damages or destroys anything that is part of the cargo, supplies or fittings in a Falleen ship,
steals from another sentient during galactic trade
does or attempts to do a mutinous act on a Falleen ship, or
counsels a person to do anything mentioned above.
financing piracy ventures or actions.

Bribery/Bribe Acceptance – Minor Offense
Anyone who commits an offense who, directly or indirectly, corruptly gives or accepts or offers to an officer or agent of the Falleen Federation, or to anyone for the benefit of that person, any money, valuable consideration, office, place or employment with intent that the person should:
interfere with the administration of justice,
procure or facilitate the commission of an offense, or
protect from detection or punishment a person who has committed or who intends to commit an offense.

Part III – MILITARY CODE OF CONDUCT

Purpose
The Ministry of Defense of the Falleen Federation was founded on the principles of honor, integrity and freedom. The following Code defines violations against the Ministry of Defense’s well-being and cites the punishments that follow.

Section I – Conduct

Insubordination – Minor Offense (Separate from Criminal Code)
Any soldier who disobeys, defies, threatens, or fails to show proper respect to a superior officer.
A subordinate who reasonably doubts the lawfulness of his superior’s command has the right and obligation to report to the latter’s superior officer and be instructed on whether such concerns are founded.
The subordinates of an officer who follow the unlawful command of the latter will neither be incriminated nor disciplined for having followed such a command for so long as they had acted in good faith.

Solicitation for Advancement – Minor Offense
Any person who, for the sole purpose of advancement within the Ministry of Defense, commits the following:
Bribery;
Favors;
Sexual favors;
Begging for promotions

Behavior Unbecoming of an Officer – Minor Offense
Any person of the Federation who acts and treats other persons with disregard and disrespect through but not limited to:
Inappropriate language;
Inappropriate imagery;
Degradation

Section II – Misuse of Equipment

Misuse of Equipment – Minor Offense
Any person who uses conferred Federation equipment outside the scope of his assigned task or duty, without the approval of his Commanding officer.

Section III – Abuse of Authority

Abuse of Authority – Felony Offense
Any officer who abuses his rank or appointment. This includes, but is not limited to:
Bribery;
Allowing unauthorized cargo or passengers into a Federation ship, vehicle or building;
Mistreatment of subordinates; and
Reckless and grossly unreasonable command decisions.

Section IV – Information Sharing

Unauthorized Information Sharing – Felony Offense
Any person who relays, or renders public, information pertaining to the internal functions, roster, inventory, missions or any other tactical or restricted subjects to people outside of his/her division or fleet without the written authorization of His Fleet commander.

Section V – Desertion

Desertion – Felony Offense
Any soldier who willfully abandons from His Majesty’s service without a duly consented leave or release thereof, or fails to report to duty with the intention of evading said service.

Part IV – Punishments

Purpose
Part IV is an effort to standardize the punishment of all offenses committed against the Falleen Federation and its citizens, as well as all offenses committed within Falleen Federation territory.

Levels of Punishments
This Code recognizes the following punishments:
Level I: Expulsion from Falleen Service and Space
Level II: Imprisonment (minimum 1 month sentence, maximum 3 month sentence.)
Level III: Demotion
Level IV: Loss of Pay

Classes of Offenses and Punishments
This Code reserves punishments as to the offenses as described below:
Capital Offenses can be punishable at any and all levels
Felony Offenses can be punishable at Level II and below
Minor Offenses can be punishable at Level III and below
Should a person be convicted of four or more minor offenses, they can be sentenced at the felony offenses level.
Should a person be convicted of three or more felony offenses, they can be sentenced at the capital offenses level.
